Ouran Li

Ouran joins the Vancouver office of Dolden Wallace Folick as an Associate Lawyer after completing his Articling term at the firm.

He has appeared at the BC Supreme Court and argued contested applications at the BC Provincial Court.

Ouran has worked alongside senior counsel and partners at the firm on a variety of construction law and coverage related matters, including the following:

Coverage and Insurance Disputes

  • Prepare reservation of rights letters following analysis of various provisions contained within CGL, D&O, E&O, course of construction, wrap-up liability, auto, and homeowner policies;
  • Prepare coverage opinions where insurers have reason to believe there was a material misrepresentation or material change in risk in the context of fire loss claims;
  • Prepare coverage opinions where property damage and “loss of use” claims were made against CGL policies containing Business Interruption Endorsement;
  • Assist with preparing opinion to CGL insurer of the prospect of a cost sharing agreement, claim for contribution and indemnity, and equitable contribution against competing D&O insurer that issued policy containing an “other valid and collectible insurance” clause;
  • Assist with trial preparation in a fire loss claim where the issues to be determined included whether there was a material change in risk, breach of warranty, proper measurement of recovery, and relief from forfeiture;

Construction and Strata

  • Attend petition hearing to determine whether strata’s refusal to grant installation of air conditioning system was significantly unfair;
  • Draft mediation brief on behalf of surveying company that was sued by a prime contractor in a construction deficiency and fee claim action;
  • Conduct interview of structural engineer who performed site inspections in a construction deficiency action;
  • Provide views on quantum in matter where geotechnical consultant was alleged to have been negligent in providing structural opinion in foundation preparation;
  • Obtain a stay of proceedings in Provincial Court strata-related matter on the basis that CRT exercised exclusive jurisdiction;

Property Damage and Subrogation

  • Attend examinations for discovery in an action involving flooding to strata property following a standpipe fire suppression test;
  • Successfully negotiated full and final resolution of claims involving flooding caused by below surface construction activities, bursting of waterpipes, failure of water filtration systems, manufacturing defects and faulty workmanship and installation;
